Comments: James' father died when Henry was 3 years old and his sister was only 2 years. They had a younger brother, Thomas, who died about 6 months after his father died (he was born around the time of his father's death), and there is some question about how he died, because shortly after that James' uncle John H. Swain (1838- ?) took the two surviving children from their mother and raised them himself on his farm in Marshall, Fauquier County, VA. Their mother was not deemed fit to care for them and was unable to do so.
James's father Thomas Henry, his two uncles John H., and James T. were all Virginia Confederate Civil War soldiers and POWs who were born in Prince George's County, MD and moved to Virginia to settle their own farms.
When his uncle John H. died. James Franklin Ely inherited the family farm in Marshall, Virginia
